These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and DomainFox (“Company,” “we,” “us,” or “our”) governing your use of the DomainFox website, platform, and associated services (collectively, the “Service”). These Terms apply to all visitors, registered users, and others who access the Service.

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using DomainFox, you represent and warrant that you meet these requirements and that you are not prohibited from using the Service under any applicable law. If you are using the Service on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with third parties.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behavior.

You agree not to use the Service to:

DomainFox provides AI-generated domain valuations, analyses, and recommendations (“AI Content”). You acknowledge and agree that:

• AI Content is provided for informational purposes only and does not constitute financial, investment, or legal advice.
• Valuations are estimates based on available data and AI modeling; actual market prices may differ significantly.
• You should independently verify any AI Content before making buying, selling, or investment decisions.
• We make no representations or warranties regarding the accuracy, completeness, or reliability of AI Content.
• We are not liable for any financial losses resulting from reliance on AI Content.

The Service may integrate with or display data from third-party services (e.g., RDAP registries, Google Trends, domain marketplaces). We do not control such third-party services and are not responsible for their availability, accuracy, or policies. Use of third-party services is subject to their respective terms and conditions.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DomainFox, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

You agree to defend, indemnify, and hold harmless DomainFox and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms which by their nature should survive termination shall survive, including but not limited to Sections 6, 7, 10, 11, 12, and 15.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive the right to participate in class action lawsuits.

These Terms, together with the Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and DomainFox with respect to the Service and supersede all prior and contemporaneous understandings, agreements, and representations.
